Information about cookies and data protection

Declaration on the obligation to provide information
The protection of your personal data is of particular concern to us. We therefore process your data exclusively on the basis of the statutory provisions (DSGVO, TKG 2003). In this data protection information we inform you about the most important aspects of data processing within the framework of our website.

Contact with us
If you contact us via the form on the website or by e-mail, the data you provide will be stored by us for the purpose of processing your enquiry and in the event of follow-up questions. We will not pass on this data without your consent.

Cookies
Our website uses so-called cookies. These are small text files that are stored on your end device with the help of the browser. They do not cause any damage. We use cookies to make our offer user-friendly. Some cookies remain stored on your end device until you delete them. They enable us to recognise your browser on your next visit. If you do not wish to do so, you can set up your browser to inform you about the setting of cookies and only allow this in individual cases. If you deactivate cookies, the functionality of our website may be limited.

Web Analysis
Our website uses functions of the web analysis service Google Analytics. The provider is Google Inc, 1600 Amphitheatre Parkway Mountain View, CA 94043, USA. Cookies are used for this purpose, which enable an analysis of the use of the website by your users. The information thus generated is transferred to the provider's server and stored there. You can prevent this by setting up your browser so that no cookies are stored.

IP anonymisation
We have activated the IP anonymisation function on this website. This means that your IP address will be truncated by Google within member states of the European Union or in other signatory states to the Agreement on the European Economic Area before it is transmitted to the USA. Only in exceptional cases do we transfer the full IP address to a Google server in the USA and shorten it there. On behalf of the operator of this website, Google will use this information for the purpose of evaluating your use of the website, compiling reports on website activity and providing other services relating to website activity and internet usage. The IP address transmitted by your browser within the framework of Google Analytics is not combined with other data from Google.

Browser Plugin
You may refuse the use of cookies by selecting the appropriate settings on your browser, however please note that if you do this you may not be able to use the full functionality of this website. You can also prevent the collection of data generated by the cookie and relating to your use of the website (including your IP address) to Google and the processing of this data by Google by downloading and installing the browser plugin available under the following link https://tools.google.com/dlpage/gaoptout?hl=en

Demographic characteristics in Google Analytics
This website uses the "demographic features" function of Google Analytics. This allows reports to be generated that contain information about the age, gender and interests of the site visitors. This data comes from interest-based advertising by Google as well as from visitor data from third parties. This data cannot be assigned to a specific person. You can deactivate this function at any time via the ad settings in your Google Account or generally prohibit the collection of your data by Google Analytics as described in the section "Objection to data collection".

Newsletter
You have the possibility to subscribe to our newsletter via our website. For this purpose we need your e-mail address, first name, surname and your declaration that you agree to receive the newsletter. In order to provide you with targeted information, we also collect and process voluntarily provided information on areas of interest, address, date of birth and any other fields. As soon as you have registered for the newsletter, we will send you a confirmation e-mail with a link to confirm your registration. With the help of "pixel tags" we can send e-mail messages in a format readable by the customer. We can also use them to check whether e-mails have been opened. We may use this information to reduce the number of messages sent to a customer or to stop the sending of messages. You can cancel your subscription to the newsletter at any time by completing the following form: *** Unsubscribe newsletter***
We will then immediately delete your data in connection with the newsletter dispatch.

Google Maps
We integrate the maps of the "Google Maps" service of the provider Google LLC, 1600 Amphitheatre Parkway, Mountain View, CA 94043, USA. The processed data may include, in particular, IP addresses and location data of the users, which, however, cannot be collected without their consent (usually in the context of the settings of their mobile devices). The data may be processed in the USA. Privacy Policy: https://www.google.com/policies/privacy/, Opt-Out: https://adssettings.google.com/authenticated.

YouTube
Our website uses plugins from the Google-operated YouTube page. The website is operated by YouTube, LLC, 901 Cherry Ave., San Bruno, CA 94066, USA. When you visit one of our pages equipped with a YouTube plug-in, a connection is established to the YouTube servers. This tells the YouTube server which of our pages you have visited. If you are logged in to your YouTube account, you enable YouTube to assign your surfing behaviour directly to your personal profile. You can prevent this by logging out of your YouTube account. Further information on the handling of user data can be found in the YouTube privacy policy at https://policies.google.com/privacy?hl=en&gl=en

Facebook-Plugins (Like-Button)
Our pages integrate plugins from the social network Facebook, provider Facebook Inc, 1 Hacker Way, Menlo Park, California 94025, USA. You can recognise the Facebook plugins by the Facebook logo or the "Like Button" ("Like") on our site. You can find an overview of the Facebook plugins here: https://developers.facebook.com/docs/plugins/. When you visit our pages, the plugin establishes a direct connection between your browser and the Facebook server. Facebook thereby receives the information that you have visited our site with your IP address. If you click the Facebook "Like-Button" while you are logged in to your Facebook account, you can link the contents of our pages on your Facebook profile. This enables Facebook to assign visits to our pages to your user account. We would like to point out that we, as the provider of the pages, have no knowledge of the content of the transmitted data or its use by Facebook. You can find further information on this in the Facebook privacy policy at https://www.facebook.com/policy.php. If you do not want Facebook to be able to assign visits to our Pages to your Facebook user account, please log out of your Facebook user account.

Your rights
You are basically entitled to the rights of information, correction, deletion, restriction, data transferability, revocation and objection. If you believe that the processing of your data violates data protection law or that your data protection rights have otherwise been violated in any way, you can complain to the supervisory authority. In Austria this is the data protection authority.

Information on the data protection officer must be published. Please add the following text (preferably before the paragraph "Your rights"):

"We take the protection of personal data seriously and have appointed an external data protection officer for this purpose. The data protection officer of Hochkönig Tourismus GmbH is MMag. Martin Zeppezauer, Thurnbichlweg 50, A-6353 Going am Wilden Kaiser (www.zepedes.com) You can contact our data protection officer at the email address martin@zepedes.com."

Since the Schrems II ruling, I believe that there is no legal basis for data transfers to the USA other than informed consent. The new cookie banner is an exemplary solution to the problem of consent, since cookies and plug-ins are only set after the user has consented. However, I recommend to add the following text in the privacy policy (preferably in the Cookies section before the link "Cookie settings"):

"Through the services Google Analytics, Google Maps, Youtube and Facebook plugins (Like-Button) integrated into our website, your data will also be transmitted (at least in some cases) to the USA. Authorities or secret services in the USA can access your data without any legal options being available to you. The EUGH has therefore determined that there is no sufficient level of data protection in the sense of Art 45ff DSGVO for data transfers from the EU to the USA. For this reason, the legal basis for the use of this service is your express consent pursuant to Art. 49 para. 1 lit. a DSGVO ivm. Art. 6 para. 1 lit. a DSGVO".
